Terms of Service

1. Acceptance of Terms

By accessing or using AIEnhance.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We reserve the right to update these terms at any time; continued use constitutes acceptance of updated terms.

2. Eligibility

You must be at least 13 years of age to use AIEnhance.io. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

3. Credits & Billing

• Guest users receive 20 free credits tracked via a browser cookie. These credits are non-transferable and expire when the cookie is cleared.
• Registered users receive 20 welcome credits on account creation.
• Paid plans provide a credit allocation per billing cycle as described on the Pricing page.
• Credits are deducted only upon successful completion of an enhancement or generation task.
• Credits have no cash value and cannot be refunded, transferred, or rolled over between billing cycles (except for yearly plans which grant the full annual allocation upfront).
• We reserve the right to adjust credit costs with reasonable notice.

4. Subscriptions, Cancellations & Refunds

• Paid subscriptions are billed monthly or annually via Stripe. Subscriptions renew automatically on the same date each billing cycle.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain full access and all remaining credits until that date.
• We do not issue refunds for any paid billing period, whether full or partial. Once a payment is processed, the corresponding credits are granted and the period is considered used.
• Yearly plans grant the full annual credit allocation upfront. Cancellation of a yearly plan stops future renewals but does not entitle you to a refund of the remaining unused portion.
• If you believe a charge was made in error, contact us at [email protected] within 14 days and we will review your case.

5. Acceptable Use

You agree not to use AIEnhance.io to:

• Upload or generate illegal content, including content that violates copyright, privacy, or obscenity laws
• Create deepfakes or synthetic media intended to deceive or harass individuals
• Attempt to circumvent credit limits, rate limits, or authentication mechanisms
• Scrape, copy, or resell the Service or its outputs without written permission
• Use the Service for automated bulk processing without an enterprise agreement
• Engage in any activity that disrupts or degrades the Service for other users

Violation of this policy may result in immediate account termination without refund.

6. Intellectual Property

You retain full ownership of images you upload. By uploading an image, you grant AIEnhance.io a temporary, non-exclusive license to process the image solely to deliver the requested output. We do not claim ownership of your images and do not use them for model training.

Enhanced outputs are provided for your use under the same ownership as the original image. The AIEnhance.io name, logo, and proprietary software remain our intellectual property.

7. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We do not guarantee that AI enhancements will meet your expectations, that the Service will be uninterrupted, or that outputs will be free of artifacts. AI-generated results are inherently variable.

8. Limitation of Liability

To the maximum extent permitted by law, AIEnhance.io shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data or commercial loss. Our total liability to you shall not exceed the amount you paid in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which AIEnhance.io is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by applicable law.
